Privacy Policy

When we mention “Equias”, “we”, “us” or “our” in this Privacy Policy, we are referring to the company Equias B.V. responsible for processing your personal data. This Privacy Policy sets out the steps that we take to ensure that any information provided to us is kept secure and confidential and is used only for the purposes for which it is provided.

Information about the processing of personal data

In the following we inform you about the processing of personal data when using our website. Personal data means any information relating to you as identified or identifiable natural person; an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person. Collection and use of your personal data on our website

When you visit our website, we may collect the data that your browser transmits to our server. We collect the following data that is technically necessary to display the website and to ensure stability and security (legal basis is Art. 6 (1) 1 lit. f GDPR): IP-address, date and time of access, time zone difference to Greenwich Mean Time (GMT), content of access (specific site), access status/HTTP-status codes, volume of data transmitted, website from which the access takes place, browser, operating system and its surface and the language and the version of the browser software. If you register with us or contact us by email, we will store the personal data you have sent us (your email-address, possibly your name, your telephone number and other contact information). We may ask you to provide more information after you register to obtain additional services and information or to resolve complaints or concerns. The information that you provide to us may be used only for the following purposes:

  • To provide information or services to you as requested by you.
  • For internal review.
  • To improve the content of the website.
  • To customise the content and/or layout of the website for each individual user.
  • To compile and disclose statistics about our users and their preferences. However, these statistics are anonymous and do not identify individual users.

We will delete your personal data after the storage is no longer necessary. In the case that legal storage obligations exist we will restrict the processing.

We will not pass any of your personal data to any third party, other than members of Equias or its authorised subcontractors that need to have access to this data for the performance of subcontracted services to Equias (as a data processor obliged to a contract in accordance with Art. 28 GDPR), without your consent. No promotional offers or advertising will appear on the Equias website, nor will your personal data ever be given, sold, or otherwise shared by Equias with third parties for advertising or marketing purposes.

Collection and use of your personal data in our Equias services and the eRR-Remit Service

If you use our Equias services as an Equias Licensed User, we collect and process for the duration of the contract, or longer if required by law or applicable regulation, your contact information (name, title, email address, telephone, postal address and any other relevant contact information) and your user credentials (login data, password) as well as technical information (IP address and browser meta data) to provide Equias services to you (Art. 6 (1) lit. b GDPR). Where we collect and process information of your employees (name, title, email address, telephone, postal address and any other relevant contact information) and user credentials of your employees as well as technical information (IP address and browser meta data) of your employees, such processing is based on our legitimate interest to provide the Equias services to you (Art. 6 (1) lit. f GDPR).

We may process the IP address of your device that connects to our Equias service to ensure that the IP address matches the IP address of the company licensing the Equias services for security and licensing purposes (Art. 6 (1) lit. f. GDPR).

If you use in addition our eRR Remit Service as a Licensed User, we process any personal data in accordance with Appendix 3 Central Matching Service
– Sub-Appendix regarding Electronic Regulatory Reporting – REMIT and applicable regulation, and the respective information have been provided to you before you access the eRR Remit Service (Art. 6 (1) lit. b GDPR) and such processing is based on our legitimate interest to provide the Equias services to you (Art. 6 (1) lit. f GDPR).

Your rights

You have the following rights in regard to your personal data:

  • right of access
  • right to rectification, erasure and restriction
  • right to object to the processing of personal data. on grounds relating to your particular situation, at any time to processing of personal data concerning you which is based on Article 6(1) lit. f GDPR, including profiling based on those provisions. We shall no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of legal claims. Where we process personal data for direct marketing purposes you shall have the right to object at any time to processing of personal data concerning you for such marketing.
  • right to data portability

You have also the right to lodge a complaint with a supervisory authority about the processing of your personal data by us.

Security for your personal data

We have implemented technology safeguards, security policies and other measures to protect data under our control from unauthorised access, improper use, alteration, unlawful or accidental destruction or accidental loss.
